The Internal Revenue Service (IRS) has released updated guidance regarding Health Savings Account (HSA) contributions that may qualify for recovery by the employer. Previously, the IRS released Notice 2008-59, which provided a limited number of circumstances in which contributions could be recouped. Recently, the IRS released a new information letter which expands upon this notice by allowing employers to recover contributions in more situations. This “Compliance Bulletin” provides information about this latest guidance, including examples of possible correctible errors.
