Executive Order Issued to Strengthen the ACA

Aimed at strengthening the Affordable Care Act (ACA) and Medicaid, President Biden signed an executive order on January 28 that directs the Department of Health and Human Services (HHS) to consider a special enrollment period for the federal exchange. The president proposed the special enrollment period that would be open from February 15 through May 15, 2021 because of the pandemic. Other departments within the government, by the executive order directive, are to review all current regulations and guidance to ascertain whether there are inconsistencies presented by the executive order and actions should be taken if any are found.

It is important to note that the executive order does not change any policies or regulations currently in place. The order is a directive for the agencies to complete their reviews and then issue final guidance and directives.
