On September 30, 2021, the Departments of Labor (DOL), Health and Human Services (HHS) and Treasury issued an additional interim final rule that detailed further requirements related to surprise billing. The No Surprises Act details the service billing parameters for non-network providers within a health plan. The updated interim details the federal arbitration process which providers, facilities or providers of air ambulance services and health plans or issuers must utilize to determine the final payment parameters for out-of-network services. The rule also requires certain providers and facilities a good faith estimate of the charges to uninsured individuals so that they can anticipate their costs when seeking health care.
